These Terms & Conditions (“Terms”) govern your use of LeadLatch (“we,” “our,” “us”) and our software, website, and services. By accessing or using our platform, you agree to these Terms.

If you do not agree, please discontinue using the service.

1. Use of Service

By using LeadLatch, you agree to:

- Provide accurate information when creating an account

- Use the platform only for lawful business purposes

- Not use the service for unsolicited or illegal messaging

- Comply with all local, provincial, and federal regulations

- You must be at least 18 years old to use LeadLatch.

2. Account Registration

- When creating an account, you agree to:

- Provide accurate contact and business information

- Maintain the security of your password

- Notify us of any unauthorized access

- Accept responsibility for all activity under your account

3. Messaging & Compliance

LeadLatch provides automated messaging services such as missed call textbacks, appointment reminders, follow-ups, and review requests.

- By using LeadLatch, you agree to:

- Only send messages to customers who have provided consent

- Not use LeadLatch for cold outreach or non-consensual marketing

- Follow SMS carrier rules and A2P 10DLC regulations

- Maintain an opt-out option for message recipients (“STOP”)

- We reserve the right to suspend accounts violating messaging rules.

4. Fees & Billing

LeadLatch operates on a subscription basis.

By subscribing, you agree that:

- Fees are billed monthly unless otherwise stated

- All payments are non-refundable

- Subscription renews automatically unless canceled

- You authorize us to charge your payment method on file

- Prices may be updated with notice

- If payment fails, services may be paused until resolved.

5. Cancellation & Termination

You may cancel your subscription at any time through your account settings or by contacting support.

Upon cancellation:

- Service access continues until the end of the billing cycle

- No refunds are provided for partial months

- Data may be deleted 30 days after account closure

- We may suspend or terminate accounts that violate these Terms or misuse the platform.

6. Data Collection & Privacy

Your use of LeadLatch is also governed by our Privacy Policy. By using the platform, you consent to:

- Collection of personal and business information

- Storage of messages, logs, and communication data

- Use of data to deliver and improve services

- Transfer of data to service providers (e.g., hosting, SMS carriers)

We do not sell your information.

7. Acceptable Use Policy

You agree NOT to use LeadLatch to:

- Send unsolicited or spam messages

- Harass, threaten, or abuse others

- Impersonate another person or business

- Upload malware, viruses, or harmful code

- Engage in illegal, fraudulent, or deceptive practices

- Violate carrier guidelines or messaging laws

- Circumvent platform limitations or security features

- Violation may result in immediate account suspension.

8. Intellectual Property

All content, software, design, and branding on LeadLatch are owned by us or licensed to us. You agree not to:

- Copy, modify, or reverse-engineer our software

- Resell access without written permission

- Use our trademarks without approval

9. Service Availability

We strive to maintain reliable uptime but do not guarantee:

- Uninterrupted service

- Error-free operation

- Message delivery delays caused by carriers, networks, or third parties

We are not responsible for lost revenue due to outages or message delays.

10. Limitation of Liability

To the fullest extent permitted by law:

- LeadLatch is not liable for indirect, incidental, or consequential damages

- We are not responsible for losses due to missed messages, delays, or failures

- Your sole remedy for dissatisfaction with the service is to discontinue using it

Your use of the platform is at your own risk.

11. Modifications to Terms

We may update these Terms at any time. Updates will be posted on this page with a revised “Last Updated” date.

Continued use of the service after changes constitutes acceptance of the updated Terms.
